FG Begins Process To Extradite James Ibori After Gaining Freedom From UK Prison

The Federal Government has commenced the process of extraditing a former governor of Delta State, Mr. James Ibori, from the United Kingdom, The PUNCH can confirm. The Southwark Crown Court had, on April 17, 2012, sentenced Ibori to 13 years in prison after the ex-governor pleaded guilty to 10 counts of money laundering and stealing $250m from the Delta State treasury. Ibori, a Peoples Democratic Party chieftain, was the governor of the state between 1999 and 2007. He was, however, released on Wednesday following a court order that declined the UK government’s request for an extension of his sentence. The UK Home Office had opposed Ibori’s release on the grounds that the process of the permanent forfeiture of his assets had yet to be completed. According to the BBC, the UK Home Secretary, Amber Rudd, did not intend to deport Ibori to Nigeria until he handed over £18m of the “proceeds of crime” he alleged the ex-governor held. The convicted former governor, was, however, allowed to go home on the condition that he would not travel out of the UK. He is currently residing at his residence on Abbey Road, London, where he is under strict surveillance from where he will report to the UK Police weekly. Impeccable sources within the Economic and Financial Crimes Commission told The PUNCH on Wednesday that the Attorney General of the Federation and Minister of Justice, Mr. Abubakar Malami (SAN), had directed the EFCC to forward the file containing the 170 charges earlier brought against Ibori in Nigeria. The EFCC operative told one of our correspondents that the Federal Government would liaise with the British government to ensure that Ibori was extradited to Nigeria. A source in the EFCC said, “We have started the process of extradition in conjunction with the Office of the AGF. We had started extradition process years ago but stopped it since he was in prison. “We have now reactivated the process. It is the AGF that will communicate with the British Government, which will then extradite Ibori to Nigeria. The court process will be sent to the UK Government for extradition.” When asked why all Ibori’s London properties had not yet been forfeited to the Federal Government despite the ample time, the EFCC source explained that the British system was such that asset recovery was done post-conviction. He added, “So, they are just starting the process and that is why he has been asked not to leave the UK but should be reporting every week. “The British Government wanted him to remain in custody but the court said he could keep coming from home; so, he will remain in the UK for now. If he does not show up in the police station, then it will be assumed that he has absconded.” Speaking with one of our correspondents on Thursday, the spokesman for the British High Commission in Nigeria, Mr. Joe Abuku, said the UK government would continue to assist Nigeria with the recovery of properties. He, however, said he could not comment on the legal proceedings against Ibori. In a terse text message to one of our correspondents, the spokesman for the EFCC, Mr. Wilson Uwujaren, said, “His (Ibori’s) fate will be determined by the provisions of the law.” A Federal High Court sitting in Asaba, Delta State, had, on December 17, 2009, discharged and acquitted Ibori of all 170 charges of corruption brought against him by the EFCC. In 2010, his case was reopened by the government of former President Goodluck Jonathan. However, all attempts to arrest the ex-governor proved abortive as the 40 policemen guarding him at his country home in Oghara, Delta State, refused to allow the EFCC to arrest him. Hundreds of youths in Delta State also confronted the EFCC operatives and prevented them from arresting the ex-governor by blocking the roads leading to his home with logs of wood. Ibori fled Oghara in controversial circumstances and subsequently fled the country to Dubai, compelling the anti-graft agency to declare the fleeing ex-governor wanted. The Federal Government could not apply for Ibori’s extradition as there was no extradition treaty between the United Arab Emirates and Nigeria at the time. However, the British Government sought Ibori’s extradition and he was deported to the UK, where he was convicted and jailed for money laundering and fraud. However, the EFCC took the matter to the Benin Division of the Appeal Court, where a three-man panel of justices on May 15, 2014, ruled that the ex-governor, who was serving a 13-year jail term in a London prison at the time, had a case to answer. The EFCC subsequently said in a statement in 2014 that the ex-governor would be re-arrested upon the completion of his prison sentence in the UK. The EFCC statement read, “With this judgment, the coast is clear for Ibori to face trial in Nigeria upon the completion of his jail term in London.” Some of the properties traced to the ex-governor include a house in Hampstead, North London, worth £2.2m; a property in Shaftesbury, Dorset, worth £311,000; a £3.2m mansion in Sandton, near Johannesburg, South Africa; a fleet of armoured Range Rovers valued at £600,000; a £120,000 Bentley Continental GT; and a Mercedes-Benz Maybach 62 bought for €407,000 cash. Ex-Delta governor released after four years Ibori was released from the UK prison, where he had spent four years and eight months. A London court ruled that the Home Office had no more powers to hold the ex-governor, who had served six-and-a-half-years of his 13-year jail term. Ibori was jailed on Tuesday, April 17, 2012, for 13 years by the Southwark Crown Court, London. He had earlier spent 645 days in detention facilities in Dubai and the UK which were deducted from his total jail term. The British Broadcasting Corporation reported on Wednesday that the application made by the Britain Home Secretary, Amber Rudd, that Ibori remained in the UK until he handed over £18m of “proceeds of crime”, failed. According to the BBC, the presiding judge, Mrs. Justice May, said, “The Secretary of State appears to have taken it upon herself that Mr. Ibori does remain in this country, in apparent contradiction of the order served earlier this year to deport him. “The position of the Secretary of State, as very candidly set out by Mr. Birdling (representing the home secretary), is that she accepts that there is an argument that she has no power to detain him. “I have decided that the balance of convenience falls heavily in favour of his immediate release. I am not prepared to impose conditions involving tagging or curfews. You don’t hold someone just because it is convenient to do so and without plans to deport them.” The judge, however, said the matter of Ibori’s deportation should be heard before the end of January. Ibori is expected to face a fresh trial in the UK meant to forfeit his assets in the country to the British government. Mixed reactions greet former governor’s release Meanwhile, the Coalition Against Corrupt Leaders called on the Federal Government to initiate the process to extradite the convicted ex-governor. The Executive Chairman of CACOL, Mr. Debo Adeniran, urged the government to ensure that Ibori did not escape justice in Nigeria. He said, “As far as we know, Mr. Ibori has not answered the allegations against him here in Nigeria. In fact, we demand that the Federal Government should immediately make an official request to the UK for the extradition of the ex-convict to Nigeria to face trial over the corruption cases against him. “It is really shameful that it was outside this country that Ibori was convicted in the UK, having wriggled through the labyrinths of our judicial system to escape justice. We believe, Ibori’s case is one of those that informed the statement credited to the former UK Prime Minister, David Cameron, that Nigeria is fantastically corrupt.” Ogor, Amori, others hail ex-gov’s release Meanwhile, Ibori’s release has sparked wild celebrations across Delta State as members of his political family returned to their various towns to celebrate the man many described as their ‘‘political mentor.” As early as 9am on Wednesday when Ibori’s release became public knowledge, there was wild jubilation by youth groups, market women and political loyalists, who had long waited for his return to the state, where he still wields substantial political power. From Oghara to Mosogar, Asaba to Agbor, Ughelli to Otu-Jeremi, Gbaramatu to Patani and Warri to Effurun and Sapele, Ibori’s release was widely celebrated while many followers of the former governor also took to social media platforms –Facebook and Twitter – on Wednesday, to celebrate his possible homecoming. A commissioner under Ibori and Special Adviser to Mr. Ahmed Makarfi-led faction of the PDP, Chief Ighoyota Amori, said the jubilation that greeted Ibori’s release was not surprising. Amori, who spoke with one of our correspondents on the telephone, said, “It’s celebration everywhere in Mosogar, Oghara, Jesse, the whole Urhobo land and Nigeria. “Our joy knows no bounds as Deltans and Nigerians and in fact, the entire Urhobo nation, await his triumphal return to his fatherland. Ibori remains our hero. He remains our political leader and mentor irrespective of what his haters think.” He added that the ex-go vernor’s political family was waiting for his return. Amori added, “We are preparing for his (Ibori) return. His coming will be made known to everyone and will be greatly celebrated by all those who love him, especially we, who he had mentored and tutored in the game of politics. Ibori is our mentor and political father.” The Delta State Chairman of the PDP, Olorogun Kingsley Esiso, declined comment, saying he would speak on Ibori’s release on a later date. The Minority Leader of the House of Representatives, Mr. Leo Ogor, said he and other political associates of the ex-governor were in a mood of celebration, noting that Ibori remained a political leader, whose release should be celebrated. Ogor, who is the member, representing Isoko Federal Constituency, said, ‘‘Ibori’s release calls for celebration. He’s our great leader whose political prowess knows no bounds. Let’s just keep politics from his release. But I know for sure Ibori will not just jump parties, but if he said we should jump, we will jump because he is our leader.” Efforts to reach Governor Ifeanyi Okowa’s Chief Press Secretary, Mr Charles Aniagwu, for reaction were unsuccessful as his telephone lines indicated they were not available at the time of filing this report. Also, activities in Asaba and its environs were paralysed on Wednesday over Ibori’s release. Joyous youths sang in Ibo along Nnebisi Road, Summit Junction, Okpanam Road and Anwai Road, where they danced to Asaba drum beats, thereby causing serious gridlock. Security agents and the popular Ogbeogonogo Market Women were not left out in the jubilation. One of the market women, Mrs. Esther Nnamdi, who spoke to one of our correspondents, said, “We are grateful to God for his mercies. Ibori is a man and a great man; we are very happy for him.” In some government offices in Asaba, civil servants spoke glowingly about Ibori, commending him on how he had developed the state. Palmer Osakwe, a civil servant told The PUNCH, “Ibori is a great man. He developed the state. We want him to be pardoned by the Federal Government. He is a man.” A lawyer in Asaba, Mr. Lawrence Egodike, appealed to the Federal Government to grant the former governor, (James Ibori) a state pardon, adding that he contributed immensely to the development of the state. The state Attorney General and Commissioner for Justice, Peter Mrakpor, who spoke to journalists in Asaba, described Ibori’s release as a welcome development, adding that he had contributed to the development of the nation. “I’m particularly grateful and hope that the Federal Government would grant him a state pardon,” he said. A statement by Ibori’s media assistant, Mr. Tony Eluemunor, confirmed the release of the former governor, but added that the convict was ordered to be released immediately. Eluemunor added, “So, in court, Ibori’s lawyers exposed the injustice in the indefinite detention the Home Office had planned for Ibori. They told the judge that there were no grounds in law under which Ibori could be detained and that his detention for one day by the Home office was unlawful .”

NNPC lifted crude oil worth N6.6trn in 22 months

The Nigeria National Petroleum Corporation (NNPC) lifted crude oil worth N6.6trillion between January 2015 and September 2016, a report by the Nigeria Extractive Industries Transparency Initiative (NEITI) has said. NEITI in its summary of the report, contained in its occasion paper series issued for December, lauded the corporation for publishing its monthly reports since August 2015. The agency however said NNPC did not publish the audited annual reports and accounts as promised and empowered by its enabling Act. NEITI also urged NNPC to collaborate with International Oil Companies (IOCs) to “carry out Value-For-Money Audit on all the Federation’s Joint ventures.” The NNPC’s Monthly Financial and Operations Reports from January 2015 to September 2016 show that the corporation lifted crude oil worth $20.93 billion (N6.598trillion) during the period. Oil lifted for domestic use had the highest value of $11.57 billion. This was followed by oil lifted for FIRS ($4.48 billion), oil lifted for exports ($4.25 billion) and oil lifted for DPR ($616 million). The highest value of crude oil lifted was in May 2015 ($4 billion), out of which total government crude oil lifting was $1.43 billion, while total IOC and Independents lifting was $2.41 billion. The lowest value of crude oil lifted was $1.96 billion recorded in January 2016 during which oil and gas pipeline vandalisms was high, it said. The report said average daily production in Q1 2015 was 2.16 million barrels per day (bpd), but dropped to 2.02 million bpd in Q2. It stayed above 2 million bpd in the four quarters of 2015. For Q1 2016, it was 2.05 million bpd but fell to 1.60 million bpd by ending of September 2016, the report showed.

FG Approves 13% Derivation For Solid Minerals Producing States - Fayemi

he Minister of Mines and Steel Development, Dr. Kayode Fayemi, has assured states on 13 per cent derivation for mineral revenue following the approval by the Federal Executive Council. “We have got approval for the implementation of the constitutionally guaranteed 13 percent derivation for mineral revenue to states, similar to the derivation that oil-producing states currently enjoy from the federation accounts,” he said. He stated this yesterday at a two-day capacity building workshop on Special Purpose Vehicles, SPVs for beneficial participation of state governments in mining, jointly organised by the Federal Ministry of Mines and Steel Development and the Sokoto State Ministry of Solid Minerals and Natural Resources Development. Fayemi said the ministry had begun some reforms in line with the recommendations of the ‘Roadmap for the Growth and Development of the Nigerian Mining Sector’ which he noted emphasised the need for collaboration between the federal government and the states as well as build stronger co-operative processes and structures. “We have reviewed our approach to licensing with regards to state ownership. While in principle we cannot give state governments licenses as separate legal entities, companies in which the states have an ownership interest can bid for and receive licenses,” he stated. The minister said they were working with governments and relevant ministries to formalise and manage artisanal miners while also working with defence and security agencies to curb illegal mining in the country. He added that the ministry had commenced the modalities for capacity building in community-based organisations and other community representatives, helping them participate in key decisions in mining operations and processes. Fayemi revealed that the conference was in furtherance of the road map and that it would highlight some of the key issues using the SPV in lieu of current regulatory factors and changing dynamics in the mining sector. In an address, Sokoto State Governor Aminu Tambuwal described mines and steel as the cornerstone of any industrial development. He disclosed efforts of Sokoto government towards diversification of the state’s economy through exploration, mapping and identification of the locations of major solid minerals in the state. The commissioner for Ministry of Solid Minerals and Natural Resources, Sokoto, Barrister Muhammad Bello Goronyo, disclosed that the state government had provided enabling environment and all necessary incentives for investors willing to operate in the state. BREAKING: Nigerian Army denies knowledge of Shekau's Dead

Buhari Moves To Sack SGF Babachir Lawal, Gets Likely Replacements

President Muhammadu Buhari is currently looking for a new secretary to the government of the federation (SGF) following the indictment of Babachir Lawal by the Senate for alleged corruption,according to recent reports. Babachir has been on the spot since the Senate indicted him of sharp practices in expending funds meant for alleviating the sufferings of the displaced in north east. The Senate on Wednesday December 14, called for the resignation of the SGF after the presentation of a report on mounting humanitarian crisis in the north-east by the Shehu Sani-led ad hoc committee, which linked Babachir to a N2.5billion fraud at the Presidential Initiative for the North East, (PINE). Daily Post citing a source, reports that persons tipped as possible replacement for the SGF include the minister of agriculture, Audu Ogbeh, and some senior serving and retired federal civil servants. According to the source, the chances of Ogbeh getting the job are strong because he was initially one of those penciled down for the SGF job before powerful forces urged the president to settle for Lawal. The source said: “Ogbeh was considered just after the APC won the presidency. He is a chieftain of the party that worked hard to help the president win, APC also won governorship in his state. “He was a former deputy speaker and former Minister; both elective and appointment based positions. Thus, that he has the requisite experience is not in doubt. “Being one of the top Northern leaders who formed APC and hasfriends across the country, the belief then was that the president would give him the seat. “Eventually, Lawal was brought, perhaps because he is not a core politician like Ogbeh and others. The source noted that if Ogbeh doesn’t become the next SGF, then Buhari might select a top technocrat for the job. He said the president had asked the DSS to carry out discreet profiling of some technocrats for the position. When asked how soon Buhari may the sack of the SGF, the source said Lawal will remain in the position till 2017. But he pointed out that the removal of Lawal was almost certain because of other misconduct the SGF had carried out in time past. “It won’t be sudden but it will happen. I do not think the president will overlook some of Lawal’s actions which have been piling. “One of such was his private abroad trip which sent tongues wagging. The SGF was discovered to have collected money to cover his expenses as if it were an official trip. “This and other allegations, I believe are distracting him lately. The office of the SGF is too sensitive and it is most likely the president will deal with the situation once and for all in a matter of weeks,” the source said.

$2.1b Arms deals: Dasuki intends to call former Pres. Goodluck Jonathan as witness

Former National Security Adviser (NSA) Sambo Dasuki, who is currently on trial for alleged mismanagement of $2.1 billion arms funds, says he intends to invite former President Goodluck Jonathan as his witness. Jonathan has in the past condemned the charges against Dasuki, claiming that there is no way the ex-NSA could have stolen about $2.2billion funds for arms. Dr. Jonathan said: “We bought warships, we bought aircraft, we bought lots of weapons for the army,” he said in a recent interview at the Oxford Union in the United Kingdom. Speaking with The Nation correspondent, Mr. Ahmed Raji (SAN), the ex-NSA’s counsel, said Dasuki wanted Jonathan to testify in court on his behalf. Raji said: “It will be desirable for Jonathan to testify for the ex-NSA. It will throw greater light into grey areas. And it will serve the interest of Justice. It will be fantastic for him to go to court to testify. Dasuki is an agent of a disclosed and known principal.” Another member of Dasuki's legal team said: “With what Jonathan said in London, the only logical thing for him to do is to see it through. “We want Jonathan to follow-through. If he backs out, it will be bad.” But, in Raji’s view, a political solution will be better than trial because of the “characters involved”. He said: “But, frankly speaking, I pray for a political solution to the problem because of the characters involved.xx “Both the accused and the government should embrace a political solution to the problem.” When asked if Dasuki was ready to proffer a political solution, he answered: “Why not? He is. He added: ”I believe the President is very sincere. He wants to reorganise Nigeria and he deserves the support of all. “With a political solution, Mr. President will be in good stead to overcome unnecessary distractions in order to succeed. “I pray that everybody will key into his vision and the economic challenges facing the nation.” Those point of advising a political solution is that it will not be “tidy” for Dasuki to mention all those who got money from his office. Among them, said a source, are a prominent traditional ruler in the North, who reportedly got N500 million and a former Head of State. A source, who spoke in confidence, said Dasuki’s defence team was banking on Jonathan’s testimony. The source said: “All is set for the defence of Dasuki, who is still insisting on an open trial to let Nigerians know the beneficiaries of the arms cash. “One of those who may testify is ex-President Goodluck Jonathan whose remarks in London appeared to be the first phase of the war chest of the ex-NSA. “You know the ex-NSA said he acted on Jonathan’s instructions in disbursing some of the cash. And from the look of things, the ex-President is now ready to accept responsibility for whatever Dasuki did. “We believe it has reached a level that Nigerians must know what really happened, how funds were disbursed and who got what. “This is why a secret trial is not a viable option, with the way things are going.” “So far, we have secured the consent of Jonathan to appear in court for Dasuki. This will make the trial worth it.” Dasuki had on December 13, 2015 said he disbursed the funds on Jonathan’s instructions. The ex-NSA said: “I wish to state as follows: That I have been publicly indicted and any statement may jeopardise my defence. Having been briefed by the EFCC investigators on why I was invited, I will answer the charges in court. As such, I do not wish to make any further statement on the matter. “That I am aware in November (I cannot remember the exact date), my office requested the CBN to exchange N10billion from the account of the Office of National Security Adviser domiciled in CBN. The money was exchanged at $47m and some Euros which I cannot remember. The exact amount was delivered at my residence. “The money was for delegates that attended the nomination convention for the PDP. Presidential nomination. The money was paid and sent to Hon. (Waripamowei) Dudafa (SSAP Household) and ADC(C-I-C) for distribution on the instruction of the President. “Based on the statement of Director of Finance and Administration (Salisu), Ibrahim Wambai, and Yazidu Ibrahim, all the cash (both foreign and local) are usually given to them for official use. “I also noted the statement of Sagir Bafarawa whose company is Dalhatu Investment in which he stated that he received the sum of N4,633,000,000 from the account of the Office of the NSA. I authorised the payment . The money was for vehicles, motorcycles for youth empowerment and women sent to Saudi Arabia. I got the proposal from the President. The investigations against Adamu conducted by Cornel Borbély, chairman of the investigatory chamber of the Ethics Committee, were opened on 9 March 2015 and the final report was passed to the adjudicatory chamber on 2 December 2016. In the final report, the investigatory chamber recommended a sanction of a two-year ban from all football-related activities (administrative, sports and any other) and a fine of CHF 20,000 for violations of arts 13, 15 and 19 of the FIFA Code of Ethics (FCE). The adjudicatory chamber under its chairman Hans-Joachim Eckert has studied the report carefully and decided to institute formal adjudicatory proceedings against Adamu, who will be allowed to state his own case. Adamu, 63, was first banned for three years and fined in November 2010 by the FIFA ethics committee for breaching bribery rules.

Star Music Trek: Day Phyno, Chidinma, Burna Boy shut down Calabar

It was a great night of music, dance and fun last Saturday at the Star Music Trek concert held at Calabar Municipal Gardens, as top acts like Sound Sultan, M.I, Burna Boy, Cynthia Morgan, Chidinma and Phyno thrilled guests to no end. Hosted by comedian LaffUp, the show kicked off at 7pm with the discovery of new talents in an open mic contest. The talents sang their versions of Star Music The Trek 2016 theme song, My City Rocks. After this, DJs Big N and Neptune gave the Calabar crowd a strong feel of the hottest songs ruling the airwaves. Dancers dressed in colourful Efik-Ibibio traditional attires presented a choreographed medley of Sunny Nneji’s Idemnobno, Face Me remix and Iyanya’s Kurukere. It was indeed an amazing way to start a show. Chidinma, popularly known as Miss Kedike formally opened the concert with a spin on homeboy, Sunny Nneji’s Oruka, before switching to her song, Olulufe. She was accompanied to the stage by a Flavour lookalike and this got the crowd cheering. Burna Boy got the audience super charged during his performance. Bursting to the stage with Wada Mo, the artiste sang a number of his hit tracks including Soke, as the crowd chorused word for word. The acclaimed ‘god-mother’ of dance hall music in Nigeria, Cynthia Morgan, gave the Calabar audience a show stopping performance. She thrilled them with hits like I’m Taken, Don’t Break My Heart, and Lead Me On. Sound Sultan’s performance was remarkable as the Ninja squad was also represented on stage. Speaking after his performance, Sultan said: “Calabar felt like home and the love I got from the hundreds of fans was unprecedented.” M.I later brought his A-game to the Calabar concert, coming off the success of his performance at Star Music The Trek Abuja. He invited a couple of his fans to the stage and ended the performance with his hit song, Bullion Van. Headliner for the Calabar gig, Phyno then took the excited audience to another height. Once he stepped on stage, Phyno did not hold back as he kept dropping hit songs that were suggested by the mesmerized crowd. And when Phyno performed Fada Fada, it was a total shutdown at the Municipal Gardens. On Saturday November 12, the music train will berth in Owerri while the grand finale holds in Lagos on November 26.

Governor Ayo Fayose of Ekiti state has said that negative prophecies against him will always fail because he is God’s project. According to him, whatever God has purposed for him could not be altered by mere wishes of men, Vanguard reports. Fayose says negative prophecies against him will fail because he is God’s project Fayose made this declaration on Sunday, December 18, in Ado-Ekiti, Ekiti state capital, during the annual Christmas Carol Service at the Government House Grounds. His statement comes on the heels of prophecies from some clerics who had predicted that he would be impeached or removed from office in less than a year after his assumption of office. But in a statement from his Chief Press Secretary, Mr Idowu Adelusi, Governor Fayose said that enemies can’t change his destiny. He also warned his aides against betrayal or subversive actions, saying whoever does that would only have himself to blame in the end. Fayose said: “God knows everything and for Ekiti and her people, we are going forward and with God all things are possible. In January this year, a cleric said I would be removed in 2016 and I am still here by God’s grace. On April 22, 2015, somebody said myself and Governor Olusegun Mimiko of Ondo State would be removed from office, but am still here. “My enemies can’t change my destiny. I am God’s project and all that he plans for my life will come to pass, no matter how bitter some people feel. Anybody with a negative prophecy against me and this state will fail. We won’t lose any battle in Ekiti. “God is bound by His words and will accomplish them.” The governor also urged the people of the state to be positive minded and hope for a better and brighter future. Recall that a popular prophet in Akure, Ondo state, last year predicted the impeachment of Ekiti and Ondo state governors. Prophet Oladipo, the founder of Faith and Victory Church in Akure who predicted Fayose’s victory last year said God showed him the controversial governor will be removed from office before the year end. Prophet Oladipo insisted that Fayose will be removed from office in six months time and his Ondo state counterpart will be impeached by December.

Archbishop Okoh made the comment while speaking with journalists during the sixth edition of the Divine Common Wealth Conference (DWCCON) in Abuja. He expressed displeasure over what he termed as seeming silence of the president on unhealthy religious happenings in the country, lamenting that it could spark off unrest in the society.
